Apple Inc: Analysis of Financial Statement Essay

I chose Apple for my course project mainly based on the fact that they release all their records to the public and they have excellent accounting practices. Their paper work is easy to read and follow and based on their records they have an endless amount of revenue in the billions. As we have discussed about Apple in class I was very intrigued how they looked in the books on a specific level of detail and this course project was the perfect way to take initiative to find out just how their numbers actually add up answering the following questions. 1. What amount of deferred tax assets or deferred tax liabilities are on the two most recent years on the balance sheet? What gives rise to these deferred taxes? What information is disclosed in the footnotes related to deferred taxes? Please define a deferred tax asset and deferred tax liability. At year end September 24 2011 the balance sheet shows following amount of deferred tax assets and liabilities: Deferred tax asset is arising due to deductible temporary differences, tax losses, and tax credits of $3.2Billion and deferred tax liabilities of $9.2Billion. Deferred revenue is recorded when the company receives payments of their products in advance or for the performance of services. It includes amount for unspecified and specified software upgrade rights and non-software services that are attached to the products of the company. It is disclosed in the footnotes that Deferred tax assets and liabilities shows the effects of tax losses, credits, and the future income tax effects of temporary differences between the consolidated financial statement carrying amounts of current assets and liabilities and their respective tax bases and are measured using en-acted tax rates that apply to their taxable income in the years in which these temporary differences are expected to be recovered or settled. Footnotes also states that company records a valuation allowance in order to reduce the def erred tax asset to the amount it thinks cannot be realized. Deferred tax asset: Deferred tax asset is defined as reduction in company’s future taxes as the company has already paid for these taxes in past. It is like a prepaid tax. It is used to reduce later period’s income taxes. Deferred tax liability: Deferred tax liability is defined as liability that the company owes but they don’t have to pay it in the current time but will be due in some future time. This often results due to difference in tax regulations and accounting practices. 2. What temporary and permanent differences does the company disclose in its footnotes? What are some other examples of temporary and permanent differences? Operating loss to carry forward /carry forward: The company had unrecognized tax benefits of 1.4 billion Guidelines for carry forwards and carrybacks: Tax law allows corporation to carry forward loss up to 20 years and they can carryback tax losses only up to 2 years. A carry forward can be used to reduce future income and in the end reducing future tax payments. 4. Does the company have a defined benefit or defined contribution plan? What are the key elements of the plan discussed in the footnotes? What amounts on the balance sheet relate to this plan? What are the differences between defined benefit and defined contribution plans? Employee contribution plan: The key element discuss in the footnotes is the rate to which the contribution is made and matching of contribution by company itself. The Company’s matching contributions to the Savings Plan were $90 million, $72 million and $59 million in 2011, 2010 and 2009, respectively. Difference between Benefit and contribution plan: In contribution the employer put certain fixed percentage of employees to the fund and invest it no loss or gain is recognized because its liability is of contributing that amount only. However in benefit plan the company promised to pay certain amount to employees due to which it has to recognize gain or losses and liability. 5. What are the earnings-per-share amounts disclosed on the income statement for the most recent year? What dilutive securities are discussed in the footnotes? Please identify and describe other examples of dilutive securities. How do these impact earnings per share? Diluted EPS: Effect on EPS of Dilutive: Dilutive EPS is calculated due to the Debt securities company issued to which company offers for conversion from debt security to Company shares. If converted, the denominator will increase and hence EPS will decrease. Other types of dilutive shares: The other types of diluted shares are warrants and share option. Bonus shares may also dilute EPS. 6. What kind of share-based compensation does the company have? What was the compensation expense for the two most recent years? What are the key elements of this plan discussed in the footnotes? Please identify and describe other types of share-based compensation. Share based Payments The Company has two kind of share based compensation one is that the company receives employees’ service in exchange of equity instrument, or of recognizing liabilities that are based on the fair value of the company stock or may be settled through issuance. The elements: The key element in the foot note is the difference between restricted stock Unit and stock option plan. In RSU’s the compensation cost is measured by closing fair value of stock at grant date. However in stock option the valuation at grant date is done through Black-Scholes-Merton (â€Å"BSM†) option-pricing model. Other types of compensation: The other types of compensation is that employees to whom compensation is paid is left with the choice whether to take cash settled i.e. by incurring liabilities or by equity settlements. 7. Does the company use the direct or indirect cash flow presentation method? What is the difference between these two methods? How does the cash flow statement agree to the other financial statements? APPLE INC. uses indirect method of cash flow. The main difference in direct and indirect method is of operating activities section. In direct method of cash flow there is a sum of all check and deposits in a particular category whereas in indirect method of cash flow we have to make adjustments in order to arrive at net cash flow from operating activities. Net cash balance calculated in the cash flow statement agrees with cash balance in the balance sheet. 8. What investing and financing activities does the company have? What are some other examples of investing and financing activities? Company has following investing activities: Purchases of marketable securities, Proceeds from maturities of marketable securities, Proceeds from sales of marketable securities, Payments made in connection with business acquisitions, net of cash acquired Payments for acquisition of property, plant and equipment and Payments for acquisition of intangible assets. Other examples of investing activities are purchase/sale of long term investments and purchase/sale of debt or equity securities of other companies. Financing activities of company: Proceeds from issuance of common stock, Excess tax benefits from equity awards and Taxes paid related to net share settlement of equity awards. Other examples of financing activities are sale of equity securities, issuance of bonds and notes, dividend paid and redeem long term debt. 9. What non-cash transactions does the company have on its cash flow statement? What are some other examples of non-cash transactions? Following are the non cash transactions of the company on its cash flow statement: $(000) Depreciation, amortization and accretion 1,814 Share-based compensation expense 1,168 Deferred income tax expense 2,868 Other non cash-transaction examples are provisions, unrealized foreign currency gains/losses and minority interests. Conclusion: This course project shows evidence in Apple’s strict guidelines and how they run their business. Comparing the numbers they have posted on their site I’m able to physically see how certain liabilities and Assets are moved and balanced in different quarters throughout the year. Seeing this also allows me to understand on how they operate in a bigger scale from a bird’s eye view. Since they are such a large company they do not hesitate to report all their taxes and pay the full amount without using shortcuts that most smaller companies are able to get away with. Based on the report from 2011 and 2010 Apple prioritizes their tax expenses with alacrity and with their triple checked system it truly leaves no room for error in their accounting department. By looking into their books, I can conclude that this company is in strong standing and that they will be around for a long time maybe for another 100 years. Most companies don’t have that kind of net value since they fall into category of accrued debt paying off an impossible bill of benefits to their employees. 1984- Orwel’s Parallelism to Modern Times Essay

Orwell wrote at a time when communism seemed likely to spread across the word, which is a similar situation that we see today in some countries. Studying the Orwell’s works is relevant as it parallels with modern times. Orwell’s writing mostly focused on the nature of human in the society; his opinion about the non-democratic world and central authority focused in social and political areas. He wanted to educate people and expose everything he was against. Through the use of symbolism, extended metaphors and intensive imagery, Orwell wrote â€Å"naturalistic novels with unhappy endings, full of detailed descriptions and arresting similes† (Orwell, Why I Write) thus turning his harsh words into an art form. In his essay, ‘Why I Write’, Orwell stated that he wanted to capture the truth of human nature. As exemplified in his story of poverty, Down and out in Paris and London; he captured the realism of life during the Spanish Civil War in Homage to Catalonia, and in The Road to Wigan Pier, Orwell studied human misery in an exploitative social order. In 1984, Orwell described utter and total hatred to people who are different, hate of evil and hate of all other humans. It is where love is described as absurd, and totally unnecessary. People are raised to hate, and hate is the primary emotion that people feel. The lack of love and kindness is what brings the society to a complete totalitarian state. Human beings instinctively crave love and care to thrive; without it, no one can experience happiness or freedom. This works well for 1984 because of its hate-driven society; however the lack of love causes unrest with those who can see the importance of love. Orwell’s non-fictional works greatly differ from his fictional works though; they both constitute the same understanding of human decency. His fictional works contained many details with the use of imagery, themes and symbolism. On the other hand, Orwell’s non-fictional works is structured differently as he utilized a first person point of view, colloquial diction and a tone that points out the moral decency of humanity. Orwell’s trend in his writing, since 1936, had been directly and indirectly against totalitarianism and for democratic socialism. Orwell confessed that he wrote â€Å"because there [was] some lie that [he wanted] to expose, some fact to which [he wanted] to draw attention, and [his] initial concern [was] to get a hearing [in the world’s politics]† (Orwell, Why I Write). While Communism might have exited the world stage in terms of competing for dominance, there needed to be a mindful and attentive presence taken against what happened when a central authority took over. Orwell didn’t criticize the act of revolution itself but the misery it could cause if the leaders grow to be corrupt, shortsighted, greedy and indifferent. He wanted to expose the most important issue that affected everyone in the world. Animal Farm was the first book he wrote to expose the Soviet myth of socialism. Even in his finest fictional novels, Orwell conveys the same basis of human reality. Nineteen Eighty-Four explored his hatred towards totalitarianism and government security. Animal Farm was his satirical, allegorical and metaphorical masterpiece elucidating his abhorrence of Stalin’s dictatorship in the Soviet Union. Orwell’s use of symbolism in 1984 reveals more about what he wanted to portray in a new creative way. His use of symbolism allowed readers to easily understand his message as well as appreciate his writing style simultaneously. For example, in 1984 Orwell used Big Brother as a symbol to represent the Party. The citizens were told that Big Brother is the leader of the nation and the head of the Party, but Winston could never determine whether or not he actually existed. In any case, the face of Big Brother symbolized the Party in its public manifestation; he is a reassurance to most people (the warmth of his name suggests his ability to protect), but he is also an open threat (one cannot escape his gaze). Big Brother also symbolizes the vagueness with which the higher ranks of the Party presented themselves—readers are left wondering who really rules Oceania, what life is like for the rulers, or why they act as they do. Additionally, in Animal Farm he used the farm to symbolize Russia and the Soviet Union under a Communist Party rule. Generally, Animal Farm stands for any human society are it capitalist, socialist, fascist, or communist. The farm reflects the dynamics of a nation represented by animals: the government (the pigs), the police force or army as the dogs and the working class as the other animals. Its location amid a number of hostile neighboring farms supports its symbolism as a political entity with diplomatic concerns. Orwell portrayed detailed symbolism in 1984 and Animal Farm, keeping both novels renowned up to the day. Orwell remains an important author as his themes reoccur in the twentieth century. His writing gives a sense of how life is a struggle but it is not to be feared – that fitting in and belonging need not be the most important goals in life. Orwell was willing to go out there and fight in trenches for what we believed and he wrote about what he thought was important. He was a great representational novelist, as seen in Nineteen Eighty-Four, for portraying the realities of mundane life in totalitarian societies in such original and artistic manner.

I know people who never write letters for whom its just a waste of time. How easy it is to reach for the telephone type a few digits and talk to person miles away from you†¦ no pondering over thoughts no addressing of envelopes and no waiting for response. No doubt, the telephone is more efficient and instant but I doubt whether it is, on the whole as effective as a letter. Letters have a certain power, your heartbeat ticks rhythmically with every comma and a full stop†¦ you can preserve a letter , read it study it, carry it around like a cherished possession. It is not momentary as a telephone call, quickly done and quickly forgotten. As I have grown over years, I have matured and hopefully become wiser. I have learned to think twice before dropping a letter written in a melancholic mood. I have regretted it because by the time the letter is received the gloominess is banished and then one is left anxiously thinking about the reaction at the other end. There were moments when shyness led me to writing letters. I would have never been able to make friends with strangers had I not been a keen writer. I cannot dream of calling up a writer, actor, painter whose work I admire, until and unless I know them personally. But without hesitation I write them letters of appreciation, and if my letter is welcomed, it is answered and if not, I’ve got nothing to lose. Its funny but I’ve maintained friendships solely through letters that may, I fear, break if there is a face to face encounter. So keep in touch. Australia Soft Drink Market Essay The FSANZ phone survey of adolescents and young adults in Australia found that Aboriginal and Torres Strait Islanders were more likely to consume sugar-sweetened soft drinks compared to other Australians (72 per cent versus 50 per cent) and consumed significantly larger amounts (249 ml versus 128 ml per day) (Food Standards Australia New Zealand 2003a). The 2004 SPANS survey of children in Years 6–10 in NSW found consumption of soft drinks to be lowest among students of Asian background and highest among boys of Southern European and Middle Eastern background (Booth et al. 2006). Gender Fewer girls than boys consume soft drink in Australia, and among those that do, girls consume smaller amounts of soft drink than boys (section 2. 2). This gender effect has been observed in Europe also. For example, the large WHO collaborative cross-national study of Health Behaviours among School-aged Children 2001–02 showed that girls generally consume less soft drink than boys (Vereecken et al. 2005b). Psycho-Social Factors 3. 2. 1 Personal Factors Personal factors appear to moderate the relationship between environmental factors and behaviour. In Norway, personal preferences, i. e. taste, was the number one determinant of soft drink consumption, and attitude was the fourth most important determinant of soft drink consumption in adolescents, with the environmental factors of accessibility and modelling (consumption behaviour of significant others) in between (Bere et al. 2007). Soft drink consumption in school-aged children has been notably correlated with taste preferences in other studies (Grimm et al. 2004). In one study of 8–13 year olds in the US, those who reported the strongest taste preference were 4. 5 times more likely to consume soft drinks five or more times per week compared with those with a lower taste preference. However, taste enjoyment was one of the most predictive expected outcome beliefs of regular soft drink consumption. In quenching of thirst was the second most important predictor of attitude, after taste, towards drinking soft drinks — yet soft drinks have been found to be poor at quenching thirst when compared to water (Rolls et al. 1990; Brouns et al. 1998). Parents and friends have been identified as being more influential than peers in the consumption patterns of younger children aged 8–9 years in the UK (May and Waterhouse 2003), although peer groups are considered to play a greater role in adolescence (Buchanan and Coulson 2006). Cost, availability and thirst were more important in older children aged 13–4 years. In the NSW Schools Physical Activity and Nutrition Survey 2004 (SPANS) of children aged 5–16 years, peer influences were not particularly apparent in soft drinks attitudes and intended consumption (Booth et al.2006). Adolescents who perceived more social pressure to limit soft drink consumption were found to be more likely to consume more in the Study on Medical Information and Lifestyle in Eindhoven (SMILE) study in The Netherlands (de Bruijn et al. 2007). The SMILE study also showed that moderate â€Å"agreeableness† (a measure of adolescents† willingness to comply with parental practices and rules) of adolescents is associated with less soft drink consumption, however, those that were most â€Å"agreeable† consumed a lot (de Bruijn et al. 2007). This was attributed to pressures outside of the home environment — pro-social motives where those most agreeable wanted to â€Å"fit in†. It is postulated that the more agreeable adolescents were more inclined to live up to expectations raised by prototype-based advertisements and marketing. One of the few studies examining the factors affecting soft drink consumption in adults showed that consumption of sugar-sweetened soft drinks was associated with less restrained and more external eating, i. e. sensitive to external stimuli such as taste (Elfhag et al. 2007). The study, conducted among 3265 adults in Sweden showed that, in contrast, diet soft drinks were consumed by persons with a higher body mass index (BMI) (possibly in an attempt to reduce their weight), more restrained eating and more emotional eating. Parents as Models A study in Australia showed that the influence of mothers, either as models of eating behaviours or as the providers of food, is pervasive (Campbell et al. 2007). Parental soft drink consumption was positively associated with younger children’s intake in two studies (Grimm et al. 2004; Vereecken et al.2004). Mother’s consumption was found to be an independent predictor for regular soft drink consumption among children in Belgium (Vereecken et al. 2004). In the US, children aged 8–13 years whose parents regularly drank soft drinks were nearly three times more likely to consume soft drinks five or more times per week compared with those whose parents did not regularly drink soft drinks (Grimm et al. 2004). A higher frequency of preparing food was found to be related to lower intakes of carbonated beverages among female adolescents in the US (Larson et al.2006). Parenting Styles Less restrictive parenting practices are associated with a higher consumption of healthier food options such as fruit and vegetables in children; however the evidence is not as equivocal for soft drinks. Indeed, the converse has been found in some recent studies. For example, van der Horst et al found that in The Netherlands less restrictive parenting practices, relating to specific behaviours such as â€Å"food rules†, were associated with higher consumption of sugar-sweetened beverages among 383 adolescents (van der Horst et al. 2007). This association was independent of perceived parenting practices by the adolescents, and was mediated by attitude, self-efficacy and modelling from parents (parental consumption). The association was strongest among adolescents who perceived their parents as being moderately strict and highly involved. These authors concluded that parents should be involved in interventions aimed at changing dietary behaviours including soft drink consumption and that interventions aimed at the promotion of healthy parenting practices are best tailored to the general parenting style of the participants (for example, strict and/or involved). More restrictive parenting practices were also found to be associated with less soft drink consumption (De Bourdeaudhuij and Van Oost 2000) and stricter parenting practices were found to be associated with less soft drink consumption in a recent study in The Netherlands (de Bruijn et al. 2007). However, findings from studies among younger children suggest that strict parental practices can in fact increase children’s preferences for, and intake of, the restricted foods. These different findings may relate to differences in the type of practices used between age groups. For example, parents of younger children might use pressure to get their children to eat more or may restrict access to certain foods. For adolescents, parents might use clearly defined rules about the times when a certain food can be eaten and how much of a certain food they can eat. Environmental Factors 3. 3. 1 Soft Drink Availability Availability at School Increased soft drink consumption has been related to the availability of soft drinks in vending machines in the school environment in a number of studies. However, it appears that when soft drinks are ubiquitous in schools the link between consumption and availability is less discernible (French et al. 2003; Grimm et al. 2004; Vereecken et al. 2005a). Access to vending machines selling soft drinks in schools in the US was not related to consumption in either boys or girls (Kassem et al. 2003; Kassem and Lee 2004). In Norway, most soft drink consumption occurs outside of school despite soft drinks currently still being available in schools (Bere et al.2007). Vending machines were not available in schools involved in a study of adolescent soft drink consumption in the UK (Buchanan and Coulson 2006); and this study found that consumption of soft drinks was higher at the weekends. Nevertheless, the availability of soft drinks at school, either in the school canteen or in vending machines, may send messages to children that they are suitable drinks; also their easy availability at schools negates the need to provide water. The sale of foods and drinks at schools is likely to have a ripple effect in the community (Bell and Swinburn 2005), thus banning soft drinks at schools conveys a healthy message to children and this message has the potential to affect community attitudes. In recent years four Australian state governments (New South Wales, Victoria, South Australia and Western Australia) have accordingly imposed a ban on the sale of soft drinks and other sugar-sweetened drinks by canteens in public schools (Bell and Swinburn 2005). In NSW this ban on sugar-sweetened drinks is part of Fresh Tastes @ School, the NSW Healthy School Canteen Strategy. Sugar-sweetened drinks with more than 300 kJ per serve or more than 100 mg of sodium per serve have not been allowed in school canteens and vending machines in NSW since Term 1, 2007 (NSW Department of Health and NSW Department of Education Training 2006). These drinks include: soft drinks, energy drinks, fruit drinks, flavoured mineral waters, sports drinks, cordials, iced teas, sweetened waters, sports waters, and flavoured crushed ice drinks. In Victoria the ban extends to high-energy, high-sugar soft drinks brought in to school. Portion Size. The beverage industry has steadily increased container sizes over the last 50 years. In the 1950s the standard serving size was a 200 ml bottle, which increased to a 375 ml can, which was superseded by a 600 ml bottle. Studies have shown that the larger the container, the more people are likely to drink, especially when they assume they are buying single-serve size containers. For example, Flood et al have shown that increasing beverage portion size from 350 ml to 530 ml significantly increased the weight of beverage consumed regardless of beverage type — in this case regular cola, diet cola or water (Flood et al.2006). As a consequence, energy intake increased 10 per cent for women and 26 per cent for men when there was a 50 per cent increase in the portion of regular cola served. Food intake did not differ under the controlled conditions; thus overall energy intake was increased as a result of the extra energy from the larger beverage intake. Most recently, a study showed that increasing portion sizes of all foods and beverages consumed by study participants by 50 per cent of baseline increased energy intake from all food and beverage categories, except fruit as a snack and vegetables, for an 11-day period (Rolls et al.2007). The amount of beverage consumed increased from about 470 ml in both women and men to 557 ml in women and 630 ml in men. Disproportionate pricing practices also encourage people to drink large servings as these often cost just a fraction more than the smaller servings (Young and Nestle 2002). Large serve sizes contribute to an â€Å"obesogenic† environment, as they facilitate excess consumption of energy (Dietary Guidelines Advisory Committee 2005). Dietary guidelines and public campaigns have highlighted the importance of portion size as a central concept related to energy intake (Matthiessen et al.2003). Cost In a number of papers, Drewnoswki and co-workers purport that the main issue in relation to nutrient-poor foods and beverages and obesity is the cost; that is, nutrient-dense diets are more costly than nutrient-poor, energy-dense foods which are relatively cheap. Drewnowski and Bellisle (2007) conclude that the obesity-promoting capacity of different beverages is linked not so much by their sugar content but by their low price, although these researchers concur that taste is likely to be the main factor affecting the obesity-promoting capacity of soft drinks (Refer to Section 3. 1). Cost was reported as being an important determinant of carbonated soft drink consumption, as opposed to fruit juice and still fruit drinks, in children aged 13–14 years in a study in the UK (Buchanan and Coulson 2006). Availability and thirst were also recognised as important determinants, although foremost was taste. Exposure to TV advertising Television is a medium through which children are commonly exposed to food marketing. Food marketers advertise heavily during children’s programming in Australia (Hastings et al.2007; Kelly et al. 2007), and soft drink is consistently featured near the top of the list of advertised food items in different countries, including Australia (Kotz and Story 1994; Lemos 2004). Increased soft drink consumption has been related to TV exposure in a number of studies (Grimm et al. 2004; van den Bulck and van Mierlo 2004; Utter et al. 2006). The relationship was observed for adolescent boys only — not girls — in a recent study of children in grades 7–8 in Belgium (Haerens et al. 2007). A study of children aged 5–6 years and 10–12 years in Melbourne showed that children who watched TV for more than 2 hours per day were 2. 3 times more likely to consume ? 1 serve/day of high-energy drinks than children who watched less than or equal to 2 hours of TV per day (Salmon et al. 2006). Functional Drinks 5. 4. 1 Sports Drinks Sports drinks were designed to aid sport performance as well as provide rehydration after sporting events. They contain 6–8 per cent carbohydrates, usually in the form of sugar, plus other electrolytes (Sports Dietitians Australia 2007). As the name implies, sport drinks are designed for sports participants. Using sport drinks for normal hydration purposes is not recommended because of their energy content (one 600 ml bottle of sport drinks provides around 780 kJ) and their acidity which is associated with the same dental health problems as soft drinks. In Australia sports drinks currently account for less than 5 per cent of the more than 1. 3 billion litres of non-alcoholic beverages sold per annum, but the sale of sports drinks is growing faster than most other beverages (Australian Convenience Store News 2006). Energy Drinks In recent years, energy drinks have also been introduced as alternative premium products to ordinary soft drinks. Their sales have risen quickly and it has been reported that in the United States energy drinks outperformed all other beverage categories, with more than 500 per cent growth in sales from 2001–06 (Montalvo 2007). The Australian Convenience Store News (Nov/Dec 2006) indicates that energy drinks accounted for 22 per cent of total drink sales. Most consumers were in the 15–39 age bracket and consumption is slightly skewed towards males (Australian Convenience Store News 2006).

They believe that they have every right to be offered the same opportunities, just like everyone else. A while ago this issue could not be spoken out aloud in public. It is unethical and uncouth to think that homosexuality is right. In todays Age much of what cultural values entail has changed over time due exposure to a new understanding, inter relation of beliefs, morals, mind-set, connotations, chain of command, religious conviction, concept of time, responsibilities, perceptions of the universe, and material entity s and possessions acquired. Communities and societies have always had their way of doing things. Most people have at one time or another found that they dont fit in the societies known culturally and social norms (Cook, 28). Occasionally this happens due to ones understanding, mind-set, connotations, chain of command, religious conviction, responsibilities, and in every community and society homosexuality has affected the social ethics. A persons sexuality and preference according to psychologists will normally be easily altered at puberty. Adolescent at times find themselves in a dilemma where they do not actually know to what sex they prefer. Some find themselves in the antagonism of the puberty unpredicted effects like same sex attraction. Somehow when looked at a critical view this kind of preference is not actually a persons fault, it is the stage in life. With this in mind gay people believe that it is actually not their fault that they are the way they are. Most people in the society will not actually put this into consideration due to so many factors and consequences that are associated when this fact is accepted. In turn, the gay people in the community feel that the only way they can be heard out is by coming together and creating one voice. This has been seen over the past years. Gay people have organized rallies, peaceful demonstrations in different places all over the world in order to have their voices heard (Phelan, 25). Years down the line this has become one large community with its own cultural standards, values and rights. In every society, there is the agreeable set of rules and norms that guide the people in day to day living. Eighty three to eighty to five percent of people in every other community will always abide to these norms (Burke, 9), but a small percentage becomes deviant to these norms. It is probably a bit difficult to determine whether a deviant person in the community is always wrong, because what determines whether they are wrong or right is what they are deviant to. Homosexuality is not accepted in so many places around the world (Bamforth, 33), and this has made the gay culture deviant (Stephen, 1). The classical justification of this fact is that a deviant culture will always push the moral boundaries of a society giving alternatives and new options to the status quo and promoting change. Most cultures usually may not always agree on what to do with people who push beyond its acceptable ways in doing things. In fact, norms and accepted social ethics violation that gain enough support may at times become acceptable, a good example being the gay people (Sharon, 1). Thus, the gay culture is deviant because in some places it has made the societies, government constitutions to rethink and redefine the moral boundaries in place. The culture as it is going against so many know defined social ethics rules. Religious and social liberals point out that being gay is against written work of most inspired men like John the Baptist from the Christian bible. Islam does not allow these acts of relationships at all so does the Hindu (Bamforth, 13). It is a bit different for the catholic dominion because today gay marriages have been joined catholic churches. The gay culture deviant as it is faced so many threats about its publicity. Gay people have lost jobs, disowned by families and at other times even their lives have been threatened. It is a definite conviction to the gay culture that there is nothing much more significant than any issues that would make any one guilty and endanger their lives or families just because of their opinion, knowledge and preference about their sexual nature. The gay culture attests that the good of humankind is tied up together by the common pursuit through shared experience toward the likelihood of the same gender relationship (Harry, 43). In the past decades talented artists and poets, musicians openly described their sexuality to the public in their writing, art and songs. The gay community associates itself with the past legends and their exceptional work. They have motivated people who have felt demoralized. Gay people are introverts. And psychologists have backed up the fact that hidden desires of se xuality due to their unaccepted nature feed the possibility of sexual lusts which leads to violations of social ethics, desires to fulfill empty cravings. Gay as a deviant culture suffers from the dominant competitive ethos. This leads to the rise of struggle in interests to gain recognition or control (Harry, 31), and defies the recognition of the accepted social ethical norms and interest which all people have in common. So many factors have led to the rise of this deviant culture. Some of this factors when looked in to, are quite justifiable to those who consider respecting human rights. For instance, a factor that leads to the gay culture becoming so publicized and famous was that some large corporations and organization simply fired and never employed people with this kind of sexual preference i.e. gay. The authorities left no room for gay people. In the United States of America, gay people have come together from so many states and joined hands in so many ways in order to be heard. The 14th amendment to the U.S. Constitution which is a protection clause necessitate states and governments to treat people in an equal manner but the fact that the equal protection clause, in the United States Constitution is not absolute and that a government has gotten the right to treat people differently and discriminate against one group if it sees that as a requirement to the interest of the majority. This fact makes the gay culture even more deviant because if it does not publicize its ways well enough then it is just a period of time and it might be considered wrong (Harry, 11). Living requires that each and everyone makes the right moral choices in order to prevent a culture from dissolving into chaos (Harry, 11). Everyone must have a stand over certain behaviors and attitudes over others. In most communities having a stand that does not violate the accepted norms is quite acceptable. In this context violation means that which goes against. Gay preference will have so many views from different people in a society and because of the huge gap in the point of agreement whether it should be accepted or not it leaves a particularly large room for those directly affected to justify why this topic should be considered acceptable just like any other. Some theories that might try to give more details in this topic have ruled out that sometimes being deviant is not wrong, and sometimes it just happens due to one perspective in regard to what information they are exposed to. When it comes to explaining deviance, there are a couple theories try to explain one of them is Mertons strain theory. He was one of the first sociologists in America and his theory generally assumes that societies give both culturally-valued goals and culturally-valued means (Peter, 21)? Theoretically the gay culture argues that this culturally valued goals and cultural valued means do not at all address issues and matters pertaining to the same gender relationship. These have led to the idea of creating a suitable environment by gay people whereby they will be able to associate with the community without any stigmatization. Gay people share so many things in common, they relate to one another than straight people in an exceedingly significant way. If we consider gay to be a community of people with common social interests and sexual preference and behavior then this becomes a culture. Gay people are considered to be more conservative with refined talent compared to straight people, and while this is just an observation by few psychologists they further explain that because gay people will probably have an associative feminine behavior, they tend to be keener in what they do, like what they dress and the way they talk. A good example would be the comparison of two magnificent artists who have different gender preference i.e. a straight artist and a gay artist; studies have shown that gay artists will want to capture every detail in their work compared to the latter. While this does not suggest that gay people are better than straight people it just gives a stronger base of argument as to why the gay cult ure is deviant. Gay theorists and activists have tried through vigorous efforts, to seek public support community in formal civil rights . The legal status of the gay community largely remains unequal and unprotected. In most governments there are no courts of appeal that look closely into hearing sexual; preference based equal protection claims. High courts have avoided in coming to a decision (Sharon, 1) as to whether this kind of cases should be looked in to in a much closer scrutiny. But due to the deviant nature of this culture it has somehow managed to be heard in some states, and these states have enacted laws prohibiting government and private discrimination on the pedestal of sexual orientation. CONCLUSION In conclusion, the fact that gay people are deviant is not entirely wrong because if they do not stand in what they know and believe in, then they will have no place in the society and as earlier mentioned, gay people are people that are not physically incapacitated due to their sexual orientation. They cannot be considered as criminals due to the fact that they are gay. Arguably the failure or success of the attempts to achieve legal equality for gays will in a tremendous way depend on how activists in this field address this deviant unprotected gay cultures needs (Peter, 55). Gay as a deviant culture is an issue that is being addressed to day all over the world today. Religion and denominations are against gay practices. Activists and scholars will have to address churches and different denominations if at all they want to be heard. Every society and community must accept that we are all equal. Discrimination is immoral and no one should be subjected to it. If s society wants to have a healthy and peaceful living, it must accept everybody regardless of their sexual orientation. It this does not happen, gay people will continue to be deviant. Gay people are said to be deviant but there is nothing wrong in that (Peter, 17). On the other hand gay people should be patient with the society every time they come out publicly to push for their rights; they should not have an ego. The gay culture has been observed to stick together because this allows them to be heard as one voice (Peter, 22). The ruling of this issue of gay as a deviant culture will entirely fall on a host of ideological, political and legal variables and at some time when the request has been fully addressed by law, the society and religion than gay culture will probably change from being deviant to a positive mindset accepted community.
